JULIE NEILL BESPOKE COLLECTION SALES TERMS & CONDITIONS

Ordering: To place an order, contact Julie Neill Designs. 

Payment: We require a 50% deposit with the remaining balance due upon completion and before the item is shipped. All deposits are non-refundable. For all Quick Ship orders and international orders, we require payment in full. By paying the deposit, you acknowledge that you have reviewed and approve of the details of your order, including but not limited to your Julie Neill Designs Invoice and any accompanying drawings, and that you have read and accept the Julie Neill Designs Terms and Conditions.

Final Balance Payment: All orders that are not paid in full within 7 days of the invoice with the final balance being issued will incur a 1%/day fee until the invoice is paid in full. All orders that are not able to be picked up from Craters and Freighters 14 days after being picked up from our studio will incur a $25/day storage fee. All fees incurred must be paid before a shipment is released. Delay in a shipment being released will incur further storage fees.

Dimension: The dimensions we display are approximate. Julie Neill lighting is handcrafted; these dimensions may vary up to several inches. Please do not assume that a style will always have the exact measurements listed. We continually make modifications to the dimensions to improve the overall look. If you need very exact dimensions, please share details of your space so that we can make sure to deliver a product that will work in your space.

Slight Irregularities: The entire line is handcrafted. There may be irregularities of the surface, size, and finish, which should be expected as a distinction of the handcrafted nature of our products and appreciated as part of the beauty of the item.

Finish: Due to the nature of the painting and plastering process (hand painting and sculpting), we will make every effort to match the color as it is on the samples and photos but cannot guarantee it.

Customizing: Any existing piece may be ordered to your specific dimensions. Our designer can also create pieces based on clients’ sketches, space, and inspiration. Please submit quote requests to us by email. Please include as many specifics as possible (photographs, etc.). Quotes will be returned in approximately 5-7 business days. Custom drawings must be approved in writing before proceeding. All custom designs remain the intellectual property of Julie Neill.

Lead Time: Standard lead time ranges from 10-16 weeks from invoice date. Lead time is subject to change even after orders are placed as there can be unexpected delays from our suppliers in the world we are living in post COVID. Lead times do not include closures for holidays.

Force Majeure: All quoted completion and delivery dates are estimates only and are subject to change by JND upon notice to You. JND shall not be liable for delays in completion or shipment or default in delivery for any reason of force majeure or for any cause beyond JND’s reasonable control including, but not limited to, (a) government action, war, terrorism, riots, civil commotion, embargoes or martial laws, (b) JND's inability to obtain necessary materials from its usual sources of supply, (c) shortage of labor, raw material, production or transportation facilities or other delays in transit, (d) labor difficulty involving employees of JND or others, (e) fire, earthquake, storm, flood or other casualty or act of God, or (f) other contingencies of manufacture or shipment. In the event of any delay in JND’s performance due in whole or in part to any cause beyond JND’s reasonable control, JND shall have such additional time for performance as may be reasonably necessary under the circumstances. Acceptance by Buyer of any goods shall constitute a waiver by Buyer of any claim for damages on account of any delay in delivery of such goods.

Returns, Exchanges, Cancellations, and Changes: All of our pieces are handcrafted to order, therefore we cannot accept returns. Orders may be changed or cancelled within 7 days of the invoice. Cancelled orders are subject to a 40% cancellation fee. All lighting purchases are final, and we do not accept any returns.

Pricing Disclaimer: Due to omissions and errors, prices are subject to change without notice. Published prices do not include any freight costs unless specified in writing by Julie Neill Designs. We provide necessary installation hardware; no other charges are included. Formal written quotes are honored for 90 days. Quotes from a prior calendar year are not honored unless there is written approval before the end of the calendar year in which the quote was written.

Shipping: All pieces are FOB New Orleans; once Julie Neill Designs releases your product with a signed release form, we are no longer responsible for damages that might occur from shipping. It will be the responsibility of the shipper. Freight is not included in price of the fixture.

ETL Listing: All Julie Neill lighting is tested and ETL listed. We recommend that only licensed electricians install our products. All lighting over 40lbs must be hung professionally and suspended independently of the electrical box. Consult a qualified structural engineer or architect to determine the correct hanging procedure.

Wattage: We use sockets rated for 75 watt bulbs and recommend the use of bulbs no higher than 40 watts.

Damages: All shipments must be inspected for loss, damage, defect, errors, and/or shortages upon delivery. Whoever receives the shipment is responsible for the inspections. Julie Neill Designs is not responsible for product damages that occur in transit or STORAGE. All of our products must be stored in a climate controlled environment. Note that damages in shipping can occur even if the container looks fine. WRITTEN NOTICE OF LOSS DUE TO DAMAGE OR SHORTAGE MUST BE REPORTED TO SHIPPER JULIE NEILL DESIGN AND CRATERS & FREIGHTERS WITHIN 5 DAYS FOR VISIBLE DAMAGE AND 12 DAYS FOR CONCEALED DAMAGE AFTER THE DELIVERY OF THE SHIPMENT TO THE DESIGNATED RECEIVER ON OUR FREIGHT BILL. ALL VISIBLE DAMAGES MUST BE NOTED ON THE CARRIER’S DELIVERY RECEIPT. RETAIN ALL PACKAGING MATERIAL, PROVIDE PHOTOGRAPHS OF THE DAMAGED ITEM AND THE PACKAGING MATERIAL AND NOTIFY THE SHIPPER JULIE NEILL DESIGN AND CRATERS & FREIGHTERS OF ANY LOSS WITHIN THE TIME SPECIFIED HEREIN. No claims can be made on merchandise that has been repaired or removed from the original delivery location prior to inspection by the carrier. Failure of the receiver to follow the above terms constitute acceptance of the product and waiver of any apparent defects, errors, or shortcomings.

ORDER PLACEMENT

By placing an order, you acknowledge that you have read and accept the Julie Neill for Visual Comfort Terms and Conditions.

ITEM AVAILABILITY

Our website does not list stock availability. A Julie Neill Designs sales representative will follow up with you after an order is placed to notify you of availability. You can always call or email us to inquire about availability.

In-stock items ship within 7 business days of order confirmation. Lead times for backordered and pre-ordered items vary and typically ship within 7 business days once back in stock.

Stock availability is subject to change at any time.

CANCELLATIONS

If you need to cancel all or part of your order, please contact us as soon as possible. Cancellations are not guaranteed until you receive an email confirming cancellation. Once an order has begun processing to ship, it may not be cancelled. If the order cannot be cancelled, please refer to our return policy.

SHIPPING

We are proud to offer free standard ground shipping on all orders shipped within the contiguous United States! Items shipped via standard ground typically arrive within 3-5 business days of the shipment date.

POST-DELIVERY INSTRUCTIONS

The recipient must open and inspect the contents of all boxes immediately upon arrival. Should you find any issues upon delivery, please contact us at 504-899-4201 for assistance. Any claims for damages must be reported within 5 business days to qualify for credits or adjustments. For the proper handling of any issues that may arise, please keep all boxes and packing materials until the product is confirmed to be in good working order.

For orders delivered by a freight carrier, items must be inspected on site and any defects must be noted on the bill of lading when signing off on delivery.

Once an order has shipped, it cannot be cancelled, rerouted, or redirected. Please do not refuse the delivery of any non-damaged shipment as this may result in additional restocking fees, return shipping fees and may void the eligibility of a refund.

RETURNS

All returns must have prior authorization and meet return requirements. Any returns received without an issued return authorization number may be ineligible for refund.

Preference returns will be accepted if they are received within 30 days from the date of delivery as long as the items have not been installed and are packaged in like new condition in their original cartons complete with all parts and packing materials.

Preference returns are assessed a 25% restocking fee. The return shipping cost is the responsibility of the customer and shipping must be arranged by the customer. You will receive an email confirming the amount of your refund once the merchandise has safely reached the Visual Comfort warehouse.

RETURN REQUIREMENTS

The following items are ineligible for return: installed or modified, customized or made to order, shades, bulbs or accessories purchased individually, final sale, last call, open box, and not in original package including outside box and all packing material.

RESTOCKING FEE

All returns are subject to a 25% restocking fee and return shipping. You will receive an email confirming the amount of your refund once the merchandise has safely reached our warehouse.

DEFECTIVE MERCHANDISE

If you encounter a defect or damage in your product, please reach out to us to request a replacement or return. Items arrived with shipping damage or lost in transit must be reported within 5 business days to qualify for credits or adjustments. Do not remove from original delivery address.

USER SUBMISSIONS

We love to see your photos! We invite you to post, share and tag your content with the hashtag #julieneilllighting and our handle @julieneilldesigns on Instagram and beyond. We also welcome you to submit your photos to info@julieneill.com for a chance to be included in our online galleries.

By uploading, submitting, sending or tagging your content on social media or through email, you give us permission to reproduce and use your content as follows:

  • You grant Julie Neill Designs permission to use, store, reproduce, modify, publicly display and distribute your content. Your content may be used for marketing purposes, including but not limited to email campaigns, blog posts, social media posts, store materials and other customer communications.
  • Our license to your content is non-exclusive and royalty free.
  • You represent and warrant that you own all rights to your content and that the distribution of your content will not violate the intellectual property rights, privacy rights or legal rights of any third party.
  • Julie Neill Designs does not claim ownership of user-generated content or endorse any opinions expressed in the materials submitted by any other users. Julie Neill Designs has the right to remove user content at any time, for any reason and without notice.
